INTRODUCTION
This privacy notice (“Notice”) explains how Arkmont Limited collects and uses personal information about you when you visit the Arkmont website (www.arkmont.co.uk) (the “Arkmont Website”), contact us, subscribe to our newsletter, attend our events or training, interact with us on LinkedIn, or deal with us in connection with the services we provide (the Arkmont Website and those services together forming the “Arkmont Services”).

This Notice explains what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully.
CHANGES TO THIS NOTICE OR YOUR PERSONAL INFORMATION
We review this Notice regularly and may update it from time to time. The date at the top of this Notice shows when it was last updated. If we make significant changes, we will take reasonable steps to bring them to your attention before they take effect, for example by email or by a notice on the Arkmont Website.
It is important that the personal information we hold about you is accurate and current. Please let us know if your personal information changes (for example, if you change your email address).
ABOUT US
The Arkmont Services are owned and operated by Arkmont Limited, a company registered in England and Wales under company number 17474696, whose registered office is at 4th Floor, Fitzrovia House, 153-157 Cleveland Street, London, England, W1T 6QW (Arkmont/we/us/our). Arkmont is the controller (also known as a data controller) of, and is responsible for, your personal information, except where this Notice says otherwise. The term “you” refers to the individual whose personal information we process.
Arkmont is registered with the Information Commission (the UK data protection regulator, which continues to be known as the ICO).
We have not appointed a data protection officer. You can contact us about any data protection matter at info@arkmont.co.uk.
The Arkmont Website provides information about Arkmont and the services we offer.
INFORMATION WE MAY COLLECT ABOUT YOU
(a) Where and how we collect personal information
We collect personal information that you provide to us when you contact us, enquire about or engage us to provide the Arkmont Services, subscribe to our newsletter or other updates, or register for or attend our events, training sessions or webinars.
The personal information that we collect depends on the context of your interactions with us and the choices you make. For example:
We collect information directly from you when we meet you in person, or when you correspond with us by post, phone, video conferencing systems, email or otherwise to make an enquiry or to discuss an engagement.
We collect personal information via the Arkmont Website, for example when you complete our contact form or a newsletter or event sign-up form.
We collect personal information when you contact or interact with us through LinkedIn or other social media and professional networking platforms, for example when you send us a message, send or accept a connection request, or follow or engage with the Arkmont LinkedIn page.
We collect personal information when you register for or attend our events, training sessions or webinars.
We collect personal information in the course of delivering the Arkmont Services to our clients (see “Information we process when working for our clients” below).
We may also receive personal information about you from other sources, namely: (i) your employer or colleagues, where your organisation engages us or registers you for an event or training session (typically your name, job title and business contact details); (ii) referral partners and professional contacts who introduce you to us (typically your name, organisation, role, business contact details and the nature of your enquiry); (iii) organisations with which we jointly run events or webinars (typically your name, organisation, job title and attendance details); (iv) our clients, in the course of an engagement (typically your name, role and information about your work that is relevant to the engagement); and (v) publicly available sources such as Companies House, your organisation’s website and professional networking sites such as LinkedIn (typically your name, role, employer and professional background).
When you visit the Arkmont Website, our website host, Squarespace, automatically collects certain technical information, such as your IP address, browser and device characteristics, operating system, referring URLs and the date and time of your visit. This information is used to deliver the Arkmont Website, keep it secure and diagnose technical problems.
(b) The types of personal information we may collect
When you use the Arkmont Services or otherwise deal with us, we may collect the following information about you (the “Information”):
Identity Data, which includes your first name, last name, job title and the organisation you work for.
Contact Data, which includes your business address, billing address, email address, telephone number and social media or professional networking profile.
Professional Profile Data, which includes information about your role, employer, professional background and interests that is publicly available, for example on LinkedIn or your organisation’s website.
Transaction Data, which includes details of the services we provide to you or your organisation, and of invoices and payments in connection with them.
Engagement Data, which includes information about you that we receive or generate in the course of delivering the Arkmont Services to our clients, such as notes of interviews and meetings and information about your role and work.
Technical Data, which includes your IP address, browser and device information, and other information about your visit to the Arkmont Website that is recorded automatically.
Marketing and Communications Data, which includes your newsletter subscription, your preferences with regards to receiving marketing from us, your other communication preferences and, where you have consented, whether you open our emails and which links you click.
Event Data, which includes your registration for and attendance at our events, training sessions and webinars, any dietary or accessibility requirements you tell us about, and photographs and recordings in which you appear.
Feedback Data, which includes your responses to feedback forms, surveys and questionnaires.
We do not generally ask for special category personal information (such as information about your health). The exception is where you tell us about dietary or accessibility requirements so that we can make arrangements for an event you are attending, which may reveal information about your health. We will only use that information for that purpose, with your explicit consent, and will delete it after the event.
If you apply to work with us, we will give you a separate privacy notice explaining how we use your information during the recruitment process.
HOW DO WE USE YOUR INFORMATION?
We use your Information for the purposes described below. For each purpose we identify the lawful basis we rely on: that the processing is necessary to enter into or perform a contract with you (Contract), necessary for our legitimate interests or those of a third party (Legitimate Interests), necessary to comply with a legal obligation (Legal Obligation), or based on your consent (Consent). Where we rely on Legitimate Interests, we also say what those interests are. Where the contract is with your organisation rather than with you personally, we rely on Legitimate Interests instead of Contract.
We may process your Information for the following purposes:
To respond to your enquiries, whether made through our contact form, by email, through LinkedIn or otherwise, and to take steps towards entering into an engagement, including preparing proposals and agreements. (Contract; or Legitimate Interests: responding to business enquiries and developing our business.)
To deliver the Arkmont Services, manage our relationship with you and your organisation, and invoice for and collect payments. (Contract; or Legitimate Interests: performing our contracts with our clients and being paid.)
To send you service-related communications, such as changes to our terms or to this Notice. (Legitimate Interests: keeping our clients and contacts informed about matters that affect them. Legal Obligation, where the law requires us to notify you.)
To send you our newsletter, where you have subscribed to it. (Consent.)
To send you other updates, insights and event invitations about Arkmont and our services by email. (Legitimate Interests: promoting our business to business contacts, where we send these to a corporate email address or you have previously enquired about or used our services and not opted out. Otherwise, Consent.)
To identify individuals at organisations that may benefit from our services, research their publicly available professional information, and contact them to introduce Arkmont. (Legitimate Interests: developing our business. See “Business development” below.)
To measure whether our newsletters and marketing emails are opened and which links are clicked, where you have agreed to this. (Consent.)
To organise and run our events, training sessions and webinars, including managing registrations, preparing name badges and, where we tell you at registration, attendee lists. (Contract; or Legitimate Interests: running successful events that help attendees make useful connections.)
To take photographs and make recordings at our events and webinars and use them to promote Arkmont. (Legitimate Interests: promoting our business and events. See “Events” below.)
To understand how people interact with the Arkmont LinkedIn page, using aggregated statistics provided by LinkedIn. (Legitimate Interests: improving our LinkedIn content. See “Our LinkedIn page” below.)
To ask for feedback on our events, training and services. (Legitimate Interests: improving our services.)
To deliver the Arkmont Website, keep it and our systems secure, and prevent and detect fraud. (Legitimate Interests: operating a functioning and secure website and protecting our business.)
To establish, exercise or defend legal claims and to enforce our terms. (Legitimate Interests: protecting our legal rights.)
To comply with our legal and regulatory obligations, including tax and accounting requirements, and to respond to lawful requests from courts, regulators and public authorities. (Legal Obligation.)
INFORMATION WE PROCESS WHEN WORKING FOR OUR CLIENTS
When we deliver services to our clients, we may process personal information about people connected with the engagement, for example our clients’ staff whom we interview or whose work we review and, where we advise on an investment or acquisition, the management and staff of the business concerned.
Where we decide how and why that information is used, we are its controller and this Notice applies. We use it to deliver the services to our client (Legitimate Interests: performing our contracts with our clients), keep it confidential, and retain it for the same period as our other engagement records.
Where we process personal information only on our client’s instructions, we act as the client’s processor and the client’s own privacy notice applies.
BUSINESS DEVELOPMENT
We may identify people who we think may be interested in our services, for example from their public professional profiles or their organisation’s website, and contact them to introduce Arkmont. Where we obtain your Information in this way, we will tell you when we first contact you, and in any event within one month, and will provide a link to this Notice.
If you ask us not to contact you again, we will stop and keep a minimal record of your request so that we can respect it.
EVENTS
We may take photographs or make recordings at our events and record our webinars, and use them to promote Arkmont and our events, for example on the Arkmont Website and LinkedIn. We will tell you before the event, or at the start of a webinar, if this will happen. If you would prefer not to appear, please tell us at the event or at info@arkmont.co.uk and we will avoid featuring you or, where practicable, remove you afterwards.
To help attendees make connections, we may display your name, job title and organisation on a name badge and, where we tell you at registration, include them in an attendee list shared with other attendees. You can ask us not to include you.
NEWSLETTERS AND EMAIL
We use a third party email marketing platform to manage our mailing list and send our newsletter and other emails. The platform processes your Information on our behalf as our service provider.
Our emails may contain technologies that tell us whether an email has been opened and which links have been clicked. We will only use these where you have agreed to this, which we will ask you to do when you subscribe, and you can withdraw your agreement at any time.
If we publish our newsletter through a platform on which you hold your own account, that platform will also process your information in accordance with its own privacy notice.
COOKIES
The Arkmont Website is hosted on Squarespace and uses only cookies that are strictly necessary for it to function and to keep it secure. These cookies do not require your consent. We do not use analytics or advertising cookies.
If we introduce cookies or similar technologies that are not strictly necessary, we will update this Notice and ask for your consent before setting them.
OUR LINKEDIN PAGE
Arkmont has a company page on LinkedIn. When you visit or interact with our LinkedIn page, LinkedIn collects information about you, including through cookies, and gives us aggregated statistics (known as Page Insights) about how people interact with the page. Page Insights do not identify you to us.
For Page Insights, Arkmont and LinkedIn are joint controllers. LinkedIn has agreed to take primary responsibility for this processing, including for providing information about it and for enabling you to exercise your rights, as set out in its Page Insights Joint Controller Addendum, which is available on LinkedIn’s website. You can also contact us at info@arkmont.co.uk.
For all other processing of your information on its platform, including messages you send us through LinkedIn, LinkedIn is an independent controller and its own privacy policy applies. We are the controller of the information we receive from you through LinkedIn and use it as described in this Notice.
USE OF AI TOOLS
We use AI-enabled software tools in running our business and delivering the Arkmont Services, for example to transcribe or summarise meetings, or to help draft and review documents. Where these tools process your Information, they do so as our service providers under contracts that restrict their use of it, and we do not permit them to use your Information to train their models.
We do not make decisions about you based solely on automated processing (including profiling) that have legal or similarly significant effects for you.
WILL YOUR INFORMATION BE SHARED WITH ANYONE?
We share your Information with the following categories of recipients:
Legal and regulatory disclosures. We disclose your Information where we are required to do so by law, for example in response to a court order or a request from a regulator, law enforcement body or other public authority.
Protection of rights. We may disclose your Information where necessary to establish, exercise or defend legal claims, or to investigate or prevent fraud or other unlawful activity.
Service providers. We share your Information with service providers who process it on our behalf, including providers of IT, cloud hosting, email, productivity and knowledge management software, AI tools, website hosting, email marketing, event management, and accounting and payment services. They may only use your Information to provide their services to us and in accordance with our instructions.
Professional advisers and insurers. We share Information with our lawyers, accountants and insurers where necessary for them to advise or insure us.
Business transfers. If we sell, merge or restructure all or part of our business, we may share your Information with the prospective buyer or successor and their advisers, subject to confidentiality obligations.
Event attendees and co-hosts. Where we tell you at registration, we may share your name, job title and organisation with other attendees. Where we run an event or webinar jointly with another organisation, we will tell you at registration if we will share your attendance details with that organisation.
With your consent. We may disclose your Information to other people where you ask us to or have consented, for example where you ask us to introduce you to a third party.
We may also share aggregated or anonymised information, from which you cannot be identified, with third parties.
IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
Some of our service providers are based outside the UK, or store Information outside the UK, including in the European Economic Area and the United States. Where we transfer your Information outside the UK, we ensure it is protected by one of the following safeguards: (i) the transfer is to a country, or to an organisation within a framework, that is approved under UK data protection law as providing an appropriate level of protection (including, for the United States, organisations certified under the UK Extension to the EU-US Data Privacy Framework); or (ii) we use the International Data Transfer Agreement or the International Data Transfer Addendum to the EU Standard Contractual Clauses approved for use in the UK. THIRD PARTY WEBSITES
The Arkmont Website may contain links to third party websites or social media channels. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this Notice.
We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the Arkmont Website. You should review the policies of such third parties and contact them directly if you have any related questions.
FOR HOW LONG DO WE KEEP YOUR INFORMATION?
We keep your Information only for as long as necessary for the purposes set out in this Notice. In particular:
Client and engagement records (including Identity Data, Contact Data, Transaction Data and Engagement Data): for the duration of the engagement and six years after it ends.
Accounting and tax records: six years from the end of the financial year to which they relate.
Enquiries that do not lead to an engagement: two years from our last contact with you.
Business development records: two years from our last contact with you, except a record of any request not to be contacted, which we keep so that we can respect it.
Marketing and Communications Data: until you unsubscribe or object, after which we keep a record of your opt-out so that we can respect it.
Event Data: two years after the event, except dietary and accessibility requirements, which we delete after the event.
Photographs and recordings used to promote Arkmont: for as long as we continue to use them for that purpose. We review them at least every two years.
Technical Data: for no longer than necessary for security and operational purposes, in line with our website host’s standard retention periods.
At the end of the relevant period we will delete or anonymise your Information. Where this is not immediately possible (for example, because your Information is held in backup archives), we will securely store it and isolate it from any further processing until deletion is possible.
HOW DO WE KEEP YOUR INFORMATION SAFE?
We have implemented appropriate technical and organisational security measures designed to protect the security of any Information we process.
We have procedures in place to deal with any suspected personal data breach and will notify you and the Information Commission of a breach where we are legally required to do so.
However, no method of transmission over the internet is completely secure, so please take care when sending Information to us, particularly by email.
YOUR CONSENT TO PROCESSING
Where we rely on your Consent, we will ask for it when we collect your Information and explain what it covers.
You may withdraw your Consent at any time by emailing info@arkmont.co.uk or, for our newsletter and marketing emails, by clicking the ‘Unsubscribe’ link in the email. Withdrawing Consent does not affect the lawfulness of processing carried out before you withdrew it.
If you withdraw your Consent, we will stop the processing that relied on it. We may continue to process your Information for other purposes where we have another lawful basis for doing so, as set out in this Notice.
MARKETING AND OPTING OUT
We may send you our newsletter and other updates, insights and event invitations about Arkmont and our services, as described above.
You have the right to object to direct marketing at any time. If you object, we will stop using your Information for direct marketing. You can do this by clicking the ‘Unsubscribe’ link in any marketing email, by replying to any introductory message we send you, or by emailing info@arkmont.co.uk.
We do not share your Information with third parties for their own marketing purposes.
If you opt out of marketing, we will still send you service-related communications, for example about an engagement or event you have booked.
WHAT ARE YOUR PRIVACY RIGHTS?
You have certain rights in relation to the Information that we hold about you. Details of these rights are set out below. To exercise any of them, please contact us at info@arkmont.co.uk. We will respond without undue delay and in any event within one month, although we may extend this by up to two further months for complex or numerous requests, in which case we will tell you. If we have reasonable doubts about your identity, we may ask you for information to confirm it before we respond.
Right of Access. You have the right to ask us for a copy of the Information that we hold about you, and for other information about how we process it. In some cases data protection law allows us to refuse all or part of a request, and where a request involves information about other people we may need to withhold or redact it to protect their rights. If we refuse your request or any part of it, we will tell you why.
Right of Correction or Completion. If Information we hold about you is not accurate or is out of date and requires amendment or correction, you have a right to have the data rectified or completed.
Right of Erasure. In certain circumstances, you have the right to request that the Information we hold about you is erased (for example, if the Information is no longer necessary for the purposes for which it was collected or processed or our processing of the Information is based only on your Consent and there are no other legal grounds on which we may process the Information).
Right to Object. Where we process your Information on the basis of Legitimate Interests, you have the right to object to that processing on grounds relating to your particular situation. We will then stop, unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or we need the Information in connection with legal claims. You also have an absolute right to object to direct marketing at any time (see Marketing and Opting Out above).
Right to Restrict Processing. In certain circumstances you have the right to ask us to restrict our use of your Information, for example while we verify its accuracy where you have challenged it.
Right of Data Portability. In certain instances, you have a right to receive the Information that we hold about you (or a portion thereof) in a structured, commonly used and machine-readable format.
In such circumstances, you can ask us to transmit your Information to you or directly to a third-party organisation on your behalf.
We are not able to guarantee technical compatibility with a third-party organisation’s systems.
Rights relating to Automated Decision-Making. You have rights in relation to decisions made about you based solely on automated processing that have legal or similarly significant effects for you. We do not make decisions of this kind.

If you are unhappy with how we have handled your Information, you have the right to complain to us. You can do so by emailing info@arkmont.co.uk or writing to us at our registered office address above. We will acknowledge your complaint within 30 days of receiving it, take appropriate steps to investigate it, keep you informed of progress, and tell you the outcome without undue delay.
You also have the right to complain to the Information Commission (which continues to be known as the ICO), the UK supervisory authority for data protection issues, at https://ico.org.uk/concerns. We would, however, appreciate the chance to deal with your concerns before you approach the Information Commission, so please contact us in the first instance.
